Terms of Service

By accessing or using SmartPOS AI ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance.

SmartPOS AI provides a cloud-based point of sale system including:

• Point of sale application
• Inventory management
• Customer management
• Sales reporting and analytics
• Employee management
• Payment processing integrations

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance.

Eligibility

You must be at least 18 years old and have the legal authority to bind yourself or your organization to these terms.

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

Subscription Plans

SmartPOS AI offers various subscription plans. Prices are subject to change with 30 days notice.

Free Trial

New accounts receive a 14-day free trial. Credit card is required for the trial period but you will not be charged for 14 days.

Billing

• Subscriptions are billed monthly or annually in advance
• Payments are non-refundable except as required by law
• Failed payments may result in service suspension
• You are responsible for all applicable taxes

Cancellation

You may cancel your subscription at any time. Service continues until the end of the current billing period.

You agree NOT to:

• Use the Service for any illegal purpose
• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malware or harmful code
• Attempt to gain unauthorized access
• Interfere with the Service's operation
• Use the Service to send spam or unsolicited messages
• Reverse engineer or decompile the Service
• Resell or redistribute the Service without authorization

Ownership

You retain all rights to your data. We do not claim ownership of your content.

Data Processing

By using our Service, you grant us permission to process your data as necessary to provide the Service. See our Privacy Policy for details.

Data Export

You may export your data at any time through the Service. Upon account termination, we retain data for 30 days before deletion.

Backups

We maintain regular backups but recommend you keep your own copies of critical data.

SmartPOS AI allows you to connect with third-party services including, but not limited to, QuickBooks Online (Intuit), PayPal, WooCommerce, and Shopify. By enabling any third-party integration, you acknowledge and agree to the following:

Authorization

When you connect a third-party service, you authorize SmartPOS AI to access, retrieve, and synchronize data between the Service and the third-party platform on your behalf. This may include sales receipts, invoices, customer records, product/item data, and financial account information.

Data Use

All data retrieved from third-party services (including QuickBooks Online, PayPal, and others) is used solely for your benefit and only for the purposes of providing the SmartPOS AI Service to you. We do not sell, share, license, or otherwise distribute your third-party integration data to any other party.

Third-Party Terms

Your use of third-party integrations is also subject to the terms of service and privacy policies of those third-party providers. We encourage you to review:

Disconnection

You may disconnect any third-party integration at any time through the Integrations settings in your SmartPOS AI backoffice. Upon disconnection:

• We immediately cease all data synchronization with the disconnected service
• Access tokens and credentials for the disconnected service are revoked and deleted from our systems
• Previously synchronized data that was imported into SmartPOS AI may remain in your account for continuity purposes unless you request its deletion

No Warranty for Third-Party Services

We do not guarantee the availability, accuracy, or reliability of any third-party service. We are not responsible for any errors, data loss, or service interruptions caused by third-party platforms.

The Service, including its design, features, and content (excluding your data), is owned by SmartPOS AI and protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without written permission.

By You

You may terminate your account at any time through account settings or by contacting support.

By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Fail to pay fees when due
• Engage in fraudulent activity
• Pose a security risk

Effect of Termination

Upon termination, your right to use the Service ends immediately. We may delete your data after 30 days.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not responsible for third-party integrations or services

Governing Law

These Terms are governed by the laws of the European Union and applicable local laws.

Dispute Resolution

Any disputes will be resolved through binding arbitration, except where prohibited by law.

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and SmartPOS AI.
